1. Acceptance of These Terms

By accessing PassHero.ca, creating an account, purchasing a product, using a free sample exam, using a paid mock exam, submitting a form, uploading documents, participating in a referral or credit program, applying as an instructor partner, or using any PassHero service, you agree to these Terms of Service.

If you do not agree with these Terms, do not use PassHero services.

2. About PassHero

PassHero is an independent Canadian online education and exam-preparation platform. We provide practice exams, mock exams, study tools, question-based learning, product access, referral features, instructor partner features, and related digital services.

PassHero is not a government agency, licensing authority, official exam provider, regulator, school board, college, university, driving authority, insurance regulator, real estate regulator, or instructor licensing body.

3. Independent Educational Platform and No Official Affiliation

PassHero materials are created for educational and practice purposes only. Practice questions, explanations, mock exams, score results, study tools, and recommendations are not official exam questions and do not replace official materials, laws, regulations, licensing requirements, training requirements, or professional advice.

Names of exams, organizations, regulators, government bodies, programs, or professional designations may be used only to identify the type of exam or subject matter being studied. Such references do not imply sponsorship, endorsement, approval, partnership, or official affiliation.

Users are responsible for verifying official exam requirements, deadlines, eligibility rules, identification requirements, fees, retake rules, and current laws directly with the applicable official authority before booking, attending, or relying on any exam-related decision.

4. Accounts and User Responsibility

Some PassHero features require an account. You agree to provide accurate, current, and complete information and to keep your account information up to date.

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must not share, sell, transfer, rent, or allow others to use your account.

PassHero may refuse registration, restrict access, suspend accounts, terminate accounts, remove access, or require verification where we reasonably believe there is misuse, fraud, security risk, payment issue, account sharing, scraping, abuse, false information, or violation of these Terms.

5. Products, Digital Access, and Expiry

PassHero may offer free sample exams, paid mock exams, question banks, study tools, access-duration products, guarantee products, bundles, extensions, and other digital services.

Product access, included exams, access duration, expiry date, renewal options, and available features are determined by the product purchased, account status, backend product configuration, and applicable program rules.

Access normally begins after successful payment, activation, or redemption. Expired products may require renewal, extension, repurchase, or reactivation. PassHero may update, correct, reorganize, add, remove, or improve content and features at any time.

Unless expressly stated otherwise, purchasing one product does not automatically grant access to unrelated products, other exam categories, other future products, instructor services, or guarantee benefits.

6. Payments, Prices, Taxes, and Order Confirmation

Prices, taxes, product descriptions, access terms, and checkout information are shown before purchase where applicable. Payments may be processed by third-party checkout or payment providers.

PassHero does not intend to store full credit card numbers on its own website systems. Payment information is handled by the applicable third-party payment provider.

After purchase, you may receive an electronic receipt, confirmation, account update, product activation, or access record. You are responsible for reviewing the order details and contacting PassHero promptly if you believe there is an error.

PassHero may correct pricing errors, product configuration errors, checkout errors, or access errors where reasonably necessary, subject to applicable law.

7. Refunds, Cancellations, and Digital Access

Refund eligibility depends on the product purchased, access status, usage history, applicable guarantee terms, applicable law, and PassHero’s review of the request.

Because PassHero products are digital services that may provide immediate access to online content, mock exams, question banks, score records, and learning tools, refunds may be limited once access has been activated or used, unless required by applicable law or approved by PassHero.

PassHero may review refund requests involving duplicate charges, technical access failures, incorrect purchases, product configuration errors, suspected fraud, chargebacks, guarantee claims, or other special circumstances.

Approved refunds will normally be returned through the original payment method where possible. PassHero may also issue site credit or another remedy where appropriate and permitted.

8. Pass Guarantee Products

PassHero may offer certain products described as “pass guarantee,” “guarantee,” or similar. These products do not mean that PassHero guarantees you will pass an official exam.

A PassHero guarantee product means only that you may be eligible for a limited refund, credit, or other remedy if you satisfy all applicable guarantee conditions, submit required proof, and pass PassHero’s review process.

Guarantee eligibility may depend on product-specific rules, including but not limited to purchase status, access period, required practice attempts, required scores, required timing before the official exam, proof of official exam failure, identity matching, account history, and absence of fraud or misuse.

PassHero may deny, reverse, reduce, or reject guarantee benefits if information is false, incomplete, altered, mismatched, unverifiable, late, abusive, fraudulent, or inconsistent with guarantee requirements.

If a separate Pass Guarantee Agreement applies to a product, that agreement controls the guarantee review and refund conditions for that product. If these Terms conflict with the specific Pass Guarantee Agreement, the Pass Guarantee Agreement controls only for the guarantee issue.

9. Referral Program, Registration Credit, Site Credit, and Cash Payouts

PassHero may offer referral rewards, registration credits, site credits, promotional credits, or cash payout features. These features are controlled by PassHero’s current backend settings, account records, program rules, eligibility rules, and administrative review.

Referral rewards and credits are not wages, salary, employment compensation, investment returns, franchise payments, partnership distributions, or guaranteed income. Participation in a referral program does not create an employment, agency, partnership, franchise, joint venture, or contractor relationship with PassHero.

Rewards may be created only for valid qualifying transactions and may be delayed, held, reversed, denied, reduced, or cancelled if the related purchase is refunded, charged back, disputed, fraudulent, duplicated, self-referred, generated through fake accounts, generated through unauthorized advertising, or otherwise ineligible.

Site credit and cash payout are separate features. Site credit may be usable only toward eligible PassHero products and may not be transferable, refundable, redeemable for cash, or usable outside PassHero unless expressly allowed. Cash payout requests may require minimum payout readiness, administrative approval, payment setup, identity verification, tax information, anti-fraud review, and compliance with applicable laws.

PassHero may request information needed for tax reporting, payout processing, fraud prevention, or legal compliance before allowing or completing a cash payout. Refusal or failure to provide required information may delay or prevent payout.

PassHero may suspend, limit, or terminate referral, credit, or payout privileges for abuse, manipulation, self-referrals, spam, misleading promotion, fake accounts, refund abuse, chargeback abuse, violation of law, or violation of these Terms.

10. Instructor Partner and Student Recommendation Lead Services

PassHero may provide instructor partner application features, instructor listing features, student recommendation request forms, student-to-instructor matching, consent-based contact release, and lead credit controls.

Instructor partner participation, public listing, lead matching, contact release, and lead credit usage are subject to PassHero’s backend settings, application review, listing status, payment or comp status, lead credit balance, recommendation eligibility, and administrative approval.

PassHero does not guarantee that any instructor will receive leads, bookings, payments, students, reviews, rankings, or business results. PassHero does not guarantee that any student will select, hire, contact, book, or pay any instructor.

Instructors are responsible for maintaining all required licences, insurance, vehicle requirements, municipal permissions, legal eligibility, tax compliance, and professional obligations. PassHero may request documents or evidence but does not replace official licensing, regulatory, insurance, or legal verification.

Student contact information should be released only where the student has consented, a match has been processed, or the applicable program rules allow the release. Instructors and students are responsible for their own communications, scheduling, payments, lessons, services, safety decisions, and legal obligations after contact is released.

PassHero may remove, suspend, hide, reject, or restrict an instructor listing or lead access where information is incomplete, expired, inaccurate, suspicious, abusive, misleading, non-compliant, unpaid, or otherwise unsuitable.

11. User-Submitted Information, Forms, and Documents

You are responsible for the accuracy, legality, and completeness of any information, form submission, file, document, proof, review, message, or other content you submit to PassHero.

You must not submit false, altered, misleading, fraudulent, infringing, unlawful, harmful, offensive, unauthorized, or third-party documents or information. You must not impersonate another person or submit another person’s information without legal authority.

PassHero may review, reject, remove, retain, or investigate submitted materials where necessary for service delivery, fraud prevention, legal compliance, audit, refund review, guarantee review, instructor review, referral review, payout review, or dispute resolution.

12. Acceptable Use and Prohibited Conduct

You agree not to misuse PassHero. Prohibited conduct includes:

• sharing, selling, transferring, renting, or reselling account access;
• copying, scraping, downloading, extracting, reproducing, or redistributing question banks or exam content without permission;
• using bots, crawlers, automation, scripts, or bulk tools to access or copy PassHero content;
• attempting to bypass payment, product access, expiry, guarantee, referral, or security controls;
• creating fake accounts, duplicate accounts, self-referrals, artificial purchases, or misleading referral activity;
• submitting false proof, altered documents, mismatched identity information, or fraudulent refund or guarantee claims;
• interfering with website security, servers, databases, software, or other users;
• using PassHero content to build, train, populate, or improve a competing question bank, exam platform, or commercial product without written permission;
• posting or transmitting spam, malware, harmful code, abusive content, misleading claims, or unlawful material;
• violating any applicable law, regulation, third-party right, or PassHero program rule.

PassHero may suspend access, remove content, deny refunds, deny guarantee benefits, reverse credits, reverse rewards, restrict payouts, terminate accounts, or take other appropriate action if prohibited conduct is suspected or confirmed.

13. Intellectual Property

PassHero owns or licenses the website design, platform structure, exam content, question banks, explanations, graphics, text, code, databases, logos, product names, page designs, learning tools, and related materials, except for content owned by third parties.

Users receive a limited, personal, non-exclusive, non-transferable, revocable right to access PassHero services for their own individual study and practice purposes during the applicable access period.

No PassHero content may be copied, republished, redistributed, sold, posted publicly, scraped, exported, used for training datasets, used for competing services, or used commercially without PassHero’s prior written permission.

14. Exam Content, Scores, and Educational Disclaimer

PassHero practice questions, mock exams, explanations, scores, progress records, and study recommendations are educational tools only. They do not guarantee official exam performance and do not replace official study materials, laws, regulations, training programs, licensing requirements, or professional advice.

Official exam content, rules, format, passing scores, eligibility, fees, booking procedures, retake rules, and legal requirements may change. PassHero may update content, but we do not guarantee that all information is complete, current, error-free, or identical to any official exam.

Users are responsible for studying appropriately, verifying official requirements, and making their own decisions before booking or attending an official exam.

15. Service Availability and Changes

PassHero aims to provide reliable access, but we do not guarantee uninterrupted, error-free, secure, or always-available service. The website may be unavailable or limited due to maintenance, updates, hosting issues, plugin issues, security events, third-party service issues, internet problems, or circumstances outside our control.

We may update, modify, correct, reorganize, suspend, discontinue, or replace any feature, page, exam, product, bundle, price, access route, referral setting, guarantee setting, instructor feature, or service where reasonably necessary.

16. Suspension and Termination

PassHero may suspend, restrict, or terminate access to any account, product, referral feature, site credit feature, payout feature, guarantee review, instructor feature, or lead feature if we reasonably believe there is a violation of these Terms, fraud, abuse, account sharing, chargeback abuse, security risk, payment issue, unlawful activity, or harm to PassHero or others.

Termination or suspension may affect access to products, exam attempts, scores, credits, rewards, guarantee eligibility, instructor listings, lead access, and other features. Certain records may be retained after termination for legal, audit, tax, accounting, fraud-prevention, dispute, refund, guarantee, referral, payout, or security purposes.

17. Limitation of Liability

To the maximum extent permitted by law, PassHero is not liable for exam failure, missed deadlines, lost study time, official rule changes, booking issues, user errors, account misuse, unavailable services, third-party service failures, indirect damages, lost profits, lost opportunities, loss of data, or consequential damages.

To the maximum extent permitted by law, PassHero’s total liability for any claim relating to a product or service is limited to the amount you paid to PassHero for the specific product or service giving rise to the claim.

Nothing in these Terms limits rights or remedies that cannot be limited under applicable law.

18. Indemnity

You agree to indemnify and hold harmless PassHero, its owners, operators, employees, contractors, partners, service providers, and affiliates from claims, damages, losses, liabilities, costs, and expenses arising from your misuse of PassHero, violation of these Terms, violation of law, infringement of rights, false information, fraudulent conduct, unauthorized document submission, referral abuse, payout abuse, guarantee abuse, or misuse of instructor or student lead information.

19. Privacy

PassHero’s collection, use, storage, protection, and disclosure of personal information are described in our Privacy Policy. By using PassHero, you agree to the Privacy Policy as part of your use of the service.

20. Governing Law

These Terms are governed by the laws of Ontario and the applicable federal laws of Canada, without regard to conflict-of-law principles.

Subject to any consumer rights or legal requirements that cannot be waived, disputes relating to PassHero or these Terms will be handled in Ontario, Canada.

21. Changes to These Terms

PassHero may update these Terms from time to time. The updated version will be posted on this page with a revised “Last updated” date. Continued use of PassHero after an update means you accept the updated Terms.

If a material change affects a paid product, guarantee program, referral program, payout program, or instructor partner program, PassHero may provide notice through the website, account area, email, or other reasonable method where appropriate.
